Service Provision Platform "Helpyk"

This Privacy Policy constitutes a legal statement explaining how Helpyk s. r. o. (the “Company,” “we,” “us,” or “our”) collects, uses, discloses, and protects the Personal Data obtained from users (Clients and Service Providers) of the "Helpyk" mobile application and web platform (the "Service").
1. Personal Data Collection
We collect information that you provide to us directly, as well as information we receive automatically during your use of the Service.
1.1. Information Provided Directly by Users (Clients and Service Providers):

1.2. Information Collected Automatically:
- Device and Usage Data: Information regarding your mobile device (hardware model, OS version), IP address, unique device identifiers, device performance, Service feature usage, traffic data, and usage statistics (e.g., profile views, time spent). Used for technical optimization, security, and debugging.
- Geolocation Data: We may collect precise or approximate geolocation data (location) to provide location-based services (e.g., filtering Service Providers by proximity or dispatching new Orders to the nearest Service Providers). The collection of precise location data is contingent upon your explicit consent via device settings and may be withdrawn at any time.
2. Legal Basis and Purpose of Data Processing
We use the collected Personal Data based on the following legal grounds:

- 3.1. Other Service Users (Transactional Disclosure): Data necessary to execute the service is shared between the parties. Service Providers receive access to Client Order details (description, location), and Clients receive access to the Service Provider’s public profile (Name, photo, rating).
- 3.2. Payment Processors: Financial data required for processing transactions is securely shared with our third-party payment partners (e.g., Stripe) in compliance with PCI DSS standards.
- 3.3. Third-Party Service Providers: We use external services (e.g., cloud hosting, analytics, push notification services) that process data strictly on our behalf and under strict confidentiality agreements.
- 3.4. Administrative and Regulatory Disclosure: Service Administrators and Moderators have access to user data, order history, and dispute data for platform governance, quality control, and dispute resolution.
- 3.5. Law Enforcement and Legal Requests: We reserve the right to disclose any information, including Personal Data, to law enforcement, government officials, or other third parties when we are legally compelled to do so, or when we believe in good faith that the disclosure is necessary to prevent physical harm or financial loss, or to report suspected illegal activity.
4. User Rights, Data Control, and Account Deletion
You have the following rights regarding your Personal Data, which we are committed to upholding:
- Right of Access and Portability: You may request a copy of the Personal Data we hold about you.
- Right to Rectification: You can update or change the information in your profile directly within the Service settings at any time.
- Right to Erasure (“Right to be Forgotten”): You have the right to request the deletion of your account and associated Personal Data. We provide a clear and easily accessible mechanism (via email to helpyk@helpyk.com or within the app settings) for all users to request the permanent deletion of their account.
- Data Retention for Legal Compliance: Please note that while we will delete your account promptly upon request, we are legally required to retain certain financial and transactional data for a defined period (e.g., tax and accounting records, data necessary for fraud prevention, or resolving outstanding disputes).
- Right to Restriction of Processing: You may request that we limit the use of your data for specific purposes (e.g., opting out of marketing communications).
- Right to Withdraw Consent: You may withdraw your consent to non-essential data processing, such as the collection of precise geolocation data or the receipt of marketing push notifications, at any time through your device or app settings.
5. Data Security and Retention
5.1. Security Measures
We employ industry-standard technical and administrative security measures (including data encryption, secure socket layer (SSL/TLS), password hashing, and access controls) designed to protect your Personal Data from unauthorized access, alteration, disclosure, or destruction.
5.2. Data Retention Policy
We retain your Personal Data for as long as your account remains active or as needed to provide you with the Service. After an account deletion request, we will initiate the deletion process, except for data that we are legally obliged to retain (as mentioned in Section 4). Retention periods comply with the laws of the Czech Republic and standard industry best practices.
6. Changes to this Policy
We reserve the right to update this Privacy Policy periodically. We will provide you with prior notice of any material changes (i.e., changes that significantly alter how we use or share your Personal Data) via email, or through a prominent notice within the Service (e.g., pop-up or push notification).
